In Montana, interactions between landlords and tenants are primarily controlled by the Residential Landlord and Tenant Act of 1977 and the Residential Tenants’ Security Deposits. For example, these laws tell landlords how to evict a tenant for nonpayment or destruction of property, and tell tenants how to request repairs to their dwellings. The laws also lay out both the landlord’s and tenant's respective rights and duties.
This page features information and forms to assist landlords and tenants. Tenants, for example, can access forms for giving notice of moving out, requesting a security deposit back, or in the case of an eviction, answering the landlord’s action for possession of the dwelling. Landlords can access forms for notifying a tenant of terminating a lease, filing a complaint with the Court to evict a tenant, and answering a tenant’s request for the return of a security deposit.
